Update on the Tomball Hills Civic Club Lawsuit
Elevated Development is committed to transparency and community partnership in every project we undertake. Recently, the Tomball Hills Civic Club filed a lawsuit seeking to prevent the subdivision and development of our Stella Lane property in Tomball.
We want to share the facts and provide clarity:
Background: The Stella Lane project received preliminary plat approval from the City of Tomball in November 2024, with plans for 38 residential lots. The design complies with the City of Tomball’s development standards and Harris County Flood Control District requirements for drainage and stormwater management.
The Lawsuit: The Civic Club’s legal action is focused on whether the property can be subdivided under the neighborhood’s deed restrictions. No injunction has been issued to stop the project. A Temporary Restraining Order (TRO) hearing in April was postponed, and Elevated voluntarily agreed not to break ground until a legal resolution has been found.
Our Position: Elevated has always sought to work collaboratively with neighbors and city officials. We have explored alternatives that address community concerns, including builder selection and enhanced drainage solutions. Our goal is not conflict, but responsible development that adds value to the neighborhood and Tomball as a whole.
Next Steps: The case is currently in pre-litigation and we are preparing to move through the courts. Elevated remains confident in the approvals already obtained and in our compliance with city and county requirements. We will continue to keep the community informed as the legal process unfolds.
We believe that growth in Tomball can, and should, be done thoughtfully. Stella Lane is designed to bring high-quality homes and lasting value to the community, and we remain dedicated to making that vision a reality.
Our Proposed Commitments to the Community
As part of our effort to move forward constructively, Stella Ln Development has offered the following commitments to ensure Stella Lane is a positive addition to Tomball Hills:
Community Green Space: We will construct a nature trail and park area for residents to enjoy.
Tree Preservation: All trees with a diameter greater than 18″ will be preserved whenever possible. If preservation isn’t feasible, we will plant a replacement tree. (SIZE?)
Deed Restriction Updates: Stella Ln Development will cover the cost of updating deed restrictions to accommodate the new section.
Community Support: We will contribute $20,000 to the Tomball Hills Civic Club maintenance fund.
These commitments reflect our approach of investing not only in new housing but also in the quality of the existing neighborhood.
